Driving Safety Course
Motorcycle Operator Training Course Request Form
With few exceptions, you have the right to complete a driving safety or motorcycle operator training course, as appropriate, if you are charged with an offense involving the operation of a motor vehicle.
YOU ARE NOT ELIGIBLE TO TAKE THE DRIVERS SAFETY COURSE IF:
1. You hold a commercial driver’s license
2. You held a commercial driver’s license when the offense was committed
3. If you are charged with passing a school bus
4. Charged with failing to stop and give information or render aid following an accident
5. Striking an unattended vehicle or fixture or highway landscape
6. If you are charged with a traffic offense committed in a construction and maintenance work zone while workers were present
7. If are charged with speeding 95 miles per hour or more
8. If you were speeding 25 miles per hour or more over the posted speed limit.
9. Your appearance date has passed.
You must have a valid Texas driver’s license, or be a member of the United States military forces serving on active duty, or the spouse or dependent child of the member. You must have proof of financial responsibility (liability insurance). You may not take the course if you are taking the course at the time of this request, or if you have completed a course within the 12 months preceding the date of the offense.
In order to take an approved Driving Safety Course or Motorcycle Operator Training and Safety Program, you must elect and request to do so. You may complete the required listed documents and return them to the Court via certified postal mail. This request must be received by the Court prior to the appearance date or postmarked by the appearance date shown on your citation.
The following items are required to be submitted to the Court to request the defensive driving option:
1. Completed reply form (from the courtesy notice given to you by the issuing officer). If you did not receive a courtesy notice from the issuing officer, please click on the tab "Criminal & Traffic Forms" to obtain a plea form by selecting "Ticket Reply Form". This must be signed and dated before a Notary public and notarized.
2. Proof of valid Texas liability insurance
3. Copy of ticket/citation
4. Self-addressed, stamped envelope (address an envelope to yourself and place a stamp on it.)
5. A copy of your current and valid Texas driver's license.
6. Court fee of $ 144.00, in the form of a cashier's check or money order. NO PERSONAL CHECKS.
Your payment is to be made payable to WASHINGTON COUNTY.
THINGS TO NOTE:
1. If your appearance date has passed, the Court cannot grant you the option for the Defensive Driving Course.
2. DO NOT sign up and/or complete a defensive driving course until the Court gives you the permission to do so.
3. You, the defendant, are responsible for finding a six-hour, state approved defensive driving program to complete. The Court cannot give you information on where to take the course. There are classes offered online and in many locations, in a classroom setting. Upon completion of said course, you will receive, via postal mail, a certificate of completion. You must sign the document and return to the Court no later than your due date given to you by the Court. Failure to submit information as required will put you in default and you will then be responsible for the remainder of the original fine amount. Not completing the defensive driving as required will result in a conviction on your driving record.
Juveniles: A defendant who is younger than 17 years of age must appear in court with a parent, guardian, or managing conservator, to enter a plea and request to take a Driving Safety Course or Motorcycle Operator Training and Safety Program
